The partner offered to conclude a marriage contract: what does it mean

According to statistics, marriage contracts are rarely concluded in our country; many Ukrainians consider such a measure excessive.

But the marriage contract has its own purpose, its conclusion gives certain advantages.

A marriage contract is not an agreement in case of a breakup, but a tool for managing the property that was acquired in marriage and protecting the property of each of the spouses.

The contract can be concluded both before the registration of marriage, if an application has already been submitted, and in marriage.

What conditions can be specified in the contract?

1. The status of property acquired during marriage (general or personal).

2. The status of the valuables received as a gift.

3. Conditions for transferring personal property to the common use of the family.

4. Features of family maintenance during the wife's pregnancy.

5. The procedure for the division of property in case of divorce.

The law says that no marriage contract can reduce guaranteed property rights a child, as well as place one of the spouses in an extremely disadvantageous position with no means of subsistence or at home.

How is a marriage contract concluded and terminated?

In order for a document to have legal force, it must be formalized and notarized. To do this, you should have a passport, marriage certificate (certificate of application) and documents confirming ownership.

The contract is terminated by agreement of the parties also at the notary.
